Video Discussion: Bankrupt Defendants

On Behalf of | Dec 24, 2020 | Business And Commercial Law, Personal Injury

In the latest episode of our firm’s video web series, which can be viewed below, firm owner John P. Fishwick, Jr., associate attorney Daniel J. Martin, and firm investigator Isaac Van Patten discuss what can be done when a defendant in a civil case files for bankruptcy. Although filing for bankruptcy results in an “automatic stay” against any effort by creditors to collect their debts from the bankrupt debtor, including pursuing a claim against the debtor in a lawsuit, there are ways to lift the automatic stay, especially when a judgment against the debtor will ultimately be paid out by an insurance company.
