Video Discussion: Marijuana Decriminalization

In the twenty-ninth episode of our firm’s video web series, which can be viewed below, firm owner John P. Fishwick, Jr., associate attorney Daniel J. Martin, and firm investigator Isaac Van Patten discuss the decriminalization of marijuana in Virginia against the backdrop of Governor Ralph Northam announcing his support for the legalization of recreational marijuana in Virginia. As of July 1, 2020, possession of recreational marijuana has been decriminalized in Virginia; specifically, offenses involving the possession of up to one ounce of marijuana are now civil violations, punishable by a maximum $25 fine, no arrest, and no criminal record. The new law also seals past marijuana convictions from employers and school administrators. Additionally, a new act was signed into law on October 13, 2020, allowing prepayment for a conviction of simple marijuana possession, similar to a traffic ticket, rather than requiring the person to appear in court.
