In the eighteenth episode of our firm’s video web series, which can be viewed below, firm owner John P. Fishwick, Jr., associate attorney Daniel J. Martin, and firm investigator Isaac Van Patten discuss depositions, an important and powerful discovery tool that we utilize in many if not all of our cases. As we explain in the video, depositions are essentially the taking of testimony outside trial, which gives us the opportunity to learn information from the opposing side or witnesses. Moreover, under the federal rules, deposition testimony can be used in motions of summary judgment (which ask the court to decide a case before it even gets to the jury). Thus, in federal courts, the proper and strategic taking of depositions becomes even more important.
