In the nineteenth episode of our firm’s video web series, which can be viewed below, firm owner John P. Fishwick, Jr., associate attorney Daniel J. Martin, and firm investigator Isaac Van Patten discuss arbitration, a method of alternative dispute resolution involving a private decision maker (the arbitrator) instead of the public court system. Often, business contracts will have a provision requiring disputes to be submitted to arbitration instead of through a lawsuit. Not all arbitration agreements are enforceable, however, especially those between businesses and individual consumers. As we discuss in the webisode, courts look to a number of factors in order to decide this issue of arbitrability, including the terms of the agreement, who signed the agreement, and how obvious it was that the document in question contained an arbitration clause.
